Same-sex marriage is not legal in Vietnam, nor is any other form of same-sex union recognized. Article 64 of the constitution could be interpreted to prohibit same-sex marriage, though the actual effect of the article remains in dispute. There has been no evident support of legal recognition for same-sex couples from the government of Vietnam. Public opinion about same-sex marriage is unknown. While negative attitudes towards homosexuality are becoming increasingly less apparent, there is still significant oppression towards homosexuals in the nation.

In 1997, Two men hosted a same-sex wedding ceremony, which drew great outrage from the community. Police responded to protests by onlookers to prosecute the two by citing that no laws that could punish the two men existed in the country. In May 1998, government officials broke up the first recorded lesbian marriage in Vietnam, which had been legally contracted due to no laws prohibiting such marriages. They later forced the two women to sign an agreement that stated they will never live with each other.Laws against cohabitation were later abolished in 2000.
